1. Acceptance of these Terms

By accessing, browsing, registering for, or using Market Window ("Market Window", "MW", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms").

These Terms apply to all visitors, registered users, shop owners, representatives, contributors and other persons who use Market Window.

If you do not agree with these Terms, please do not use Market Window.

Our Privacy Policy forms an important companion to these Terms and explains how Market Window handles personal information.

2. What Market Window is

Market Window is a marketplace-discovery platform. Its purpose is to help people discover physical shops, businesses, products and services around them before they go out to buy.

Market Window may provide information about businesses and their products, including business names, locations, contact details, descriptions, photographs, opening hours, prices, ratings and stock information where available.

A listing on Market Window does not by itself mean that Market Window owns, operates, represents, endorses or guarantees the business.

3. Eligibility and responsible use

You may use Market Window only where you are legally permitted to do so and can enter into a binding agreement under applicable law.

You are responsible for using Market Window in a lawful, honest and respectful manner.

If you use Market Window on behalf of a business or another organisation, you confirm that you have appropriate authority to act on its behalf.

4. Your account

Some Market Window features may require an account.

You are responsible for:

• Providing information that is reasonably accurate.
• Keeping your login credentials secure.
• Not sharing your password or verification credentials unnecessarily.
• Using your account only for legitimate purposes.
• Not impersonating another person or organisation.
• Not creating accounts for fraudulent or deceptive purposes.

If you believe that someone has obtained unauthorised access to your account, you should contact us and take appropriate steps to secure it.

5. Shop information and accuracy

Market Window aims to make business information useful and reliable. However, we do not guarantee that shop or product information is always accurate, complete, current or available.

Information may come from shop owners, authorised representatives, users, public sources, external business information, or other sources that we reasonably consider useful.

Business information may change without our knowledge, including:

• Shop location.
• Opening and closing hours.
• Telephone numbers.
• Prices.
• Product availability.
• Product specifications.
• Services offered.
• Business ownership or management.

6. Products, prices and stock availability

Market Window may display products and, where available, information about their prices or stock.

Product information and stock availability can change rapidly. A product shown on Market Window as available may have been sold, reserved, removed, or become unavailable by the time you contact or visit the shop.

Similarly, displayed prices may change, contain errors, exclude additional charges, or differ from the price ultimately offered by the business.

Market Window does not guarantee that a displayed product, price, quantity or offer will remain available when you contact or visit a business.

7. Transactions between buyers and businesses

Unless Market Window expressly introduces a separate transaction or payment service, purchases are made directly between the buyer and the relevant business.

This means that the business and buyer are responsible for matters such as:

• Payment.
• Product quality.
• Product authenticity.
• Delivery or collection.
• Returns and refunds.
• Warranties.
• After-sales service.
• Disputes concerning a purchase.

Market Window is not automatically a party to the contract of sale between a shop and its customer.

8. Shop claiming and business representation

Market Window may contain businesses that have not yet been claimed or verified by their owners.

A person who claims a business must provide truthful information and must not falsely claim to own, manage or represent a business.

Market Window may request information or take other reasonable steps to verify a person's authority to manage a business listing.

Claiming a listing on Market Window does not itself establish legal ownership of the underlying business.

9. User-submitted content

Market Window may allow users to submit photographs, reviews, ratings, descriptions, corrections, product information, comments and other material ("User Content").

You remain responsible for User Content that you submit.

By submitting User Content, you confirm that:

• You have the right or permission to submit it.
• It is not knowingly false or misleading.
• It does not unlawfully infringe another person's rights.
• It does not contain information that you are not permitted to disclose.
• It complies with these Terms and applicable law.

10. Permission to use User Content

When you submit content to Market Window, you grant Market Window a non-exclusive, worldwide, royalty-free permission to host, store, reproduce, resize, optimise, format, display and distribute that content as reasonably necessary to operate and provide the Market Window service.

This permission does not mean that Market Window becomes the owner of your original content.

You retain ownership of content that you own, subject to the rights necessary for Market Window to operate the service.

You should not submit content to Market Window if you do not have the necessary rights or permission to grant this licence.

11. Photographs and images

Images submitted to Market Window must be appropriate for a public marketplace-discovery platform.

You must not upload photographs or images that:

• Belong to another person where you do not have permission to use them.
• Expose another person's private or confidential information.
• Contain identity documents or sensitive personal records.
• Are intended to harass, threaten, humiliate or expose another person.
• Contain sexual or explicitly inappropriate material.
• Promote hatred, racism or discrimination.
• Promote illegal activity or prohibited goods.
• Mislead users about a business, product or service.

Market Window may remove or restrict an image where there is a legitimate concern about privacy, legality, safety, ownership, authenticity or suitability for the platform.

12. Prohibited products, services and activities

Market Window is intended for legitimate businesses, products and services. Users must not use the platform to advertise, promote, facilitate or sell illegal or prohibited products or services.

This includes, without limitation:

• Illegal drugs or controlled substances.
• Stolen goods or goods known to be unlawfully obtained.
• Weapons or other prohibited goods where their listing is unlawful or prohibited by our rules.
• Counterfeit or deliberately fraudulent goods.
• Fraudulent documents or identity information.
• Services intended to facilitate criminal activity.
• Sexually explicit or exploitative products or services.
• Content or services that exploit or endanger children.
• Religious services or religious solicitation.
• Any other product or service that Market Window reasonably determines is unsuitable for the platform.

Market Window may restrict additional categories where necessary for safety, legality, platform integrity or the interests of its users.

13. Respectful and non-discriminatory conduct

Market Window is intended to be a respectful environment for people from different backgrounds.

You must not use Market Window to publish, promote or distribute content that is hateful, racist, threatening, dehumanising or intended to discriminate against people or groups.

This includes discriminatory or hateful text, photographs, symbols, advertisements, comments, reviews or other material.

Legitimate disagreement or criticism must not be used as a justification for harassment, threats, hateful conduct or targeted abuse.

14. Reviews and ratings

Reviews and ratings are intended to help users make better-informed decisions.

Users must not:

• Create fake reviews.
• Review a business they have no legitimate basis to review.
• Manipulate ratings through multiple accounts.
• Post reviews in exchange for undisclosed incentives.
• Deliberately sabotage a competitor's reputation.
• Threaten a business with a negative review to obtain an improper benefit.
• Publish private information about an individual in a review.
• Use reviews for harassment, discrimination or personal attacks.

A user's review represents that user's experience or view. It does not automatically represent the position or opinion of Market Window.

15. Accuracy and honesty when submitting information

If you add or edit information about a shop, product or service, you should make a reasonable effort to ensure that the information is truthful and not misleading.

You must not deliberately alter information to mislead customers, damage a competitor, impersonate a business, manipulate search results, or obtain an unfair advantage.

16. Communications with businesses and users

Market Window may provide ways for users to contact businesses through telephone, WhatsApp, messaging or other communication channels.

These channels must be used responsibly.

You must not use them to:

• Spam businesses or users.
• Send threats or abusive messages.
• Harass or stalk another person.
• Send fraudulent requests.
• Impersonate another person or business.
• Attempt to obtain confidential information unlawfully.

17. Fraud, impersonation and deception

You must not use Market Window to deceive, defraud or manipulate other people.

This includes:

• Impersonating another person, shop or organisation.
• Creating fraudulent shop listings.
• Using false identities to manipulate reviews.
• Misrepresenting products or services.
• Using Market Window to conduct scams.
• Attempting to obtain money or personal information through deception.

18. Prohibited technical activities

You must not interfere with the operation, security or availability of Market Window.

This includes:

• Attempting to gain unauthorised access to accounts or systems.
• Bypassing authentication or security controls.
• Introducing malware, viruses or malicious code.
• Performing denial-of-service or similar attacks.
• Probing or testing systems without permission.
• Scraping or harvesting information in a manner that violates our rules or applicable restrictions.
• Abusing APIs or automated interfaces.
• Attempting to manipulate rankings or platform functionality.
• Interfering with another user's access to the service.

19. Intellectual property

Market Window and its original software, branding, logos, interface design, graphics, written material, databases, features and other proprietary material are protected by applicable intellectual property laws.

Unless we expressly permit it, you may not copy, reproduce, modify, redistribute, commercially exploit or create a competing service from Market Window's proprietary material.

These Terms do not transfer ownership of Market Window's intellectual property to you.

20. Third-party services and links

Market Window may contain links, maps, images, communication tools or other functionality provided by third parties.

Third-party services operate under their own terms and policies. Market Window does not control every aspect of those services and is not responsible for their independent operation, availability, policies or content.

Your use of a third-party service may therefore be subject to additional terms between you and that provider.

21. Content moderation and enforcement

Market Window reserves the right to review, restrict, remove or disable access to content that violates these Terms, applicable law, the safety of users, or the integrity of the platform.

Depending on the circumstances, Market Window may also:

• Remove or hide listings.
• Remove reviews or User Content.
• Restrict particular features.
• Require additional verification.
• Temporarily suspend an account.
• Terminate an account.
• Prevent repeated abuse from returning to the platform.
• Refer matters to appropriate authorities where legally or reasonably necessary.

We may take action even where the violation has not resulted in a complaint, particularly where immediate action is necessary to protect users or the platform.

22. Account suspension and termination

We may suspend or terminate an account where we reasonably believe that the account has been used in violation of these Terms, applicable law, or the safety and integrity of Market Window.

We may also restrict access where necessary to investigate suspected fraud, abuse, security incidents or other serious misuse.

Where appropriate, we may allow a user to request a review of an enforcement decision.

23. Availability of Market Window

We work to keep Market Window available and reliable, but we do not guarantee uninterrupted or error-free operation.

The service may occasionally be unavailable because of maintenance, updates, technical failures, network problems, security incidents, third-party service failures or circumstances beyond our reasonable control.

We may change, suspend or discontinue particular features as Market Window develops.

24. No guarantee of businesses or products

Market Window does not guarantee the quality, safety, legality, authenticity, availability or suitability of every product or service listed by a business.

We do not guarantee that every business displayed on the platform is trustworthy, licensed, authorised, available at a particular location, or suitable for a particular purpose.

Users should exercise reasonable judgment and conduct appropriate verification before purchasing products, visiting unfamiliar businesses, sending money, or providing personal information.

25. User responsibility and risk

You are responsible for your decisions when using information obtained through Market Window.

This includes deciding whether to visit a business, purchase a product, contact a business, provide information, rely on a price, or otherwise interact with a person or business discovered through the platform.

Where an action involves significant financial, legal, health, safety or personal consequences, you should independently verify the relevant information before acting.

26. Limitation of responsibility

To the extent permitted by applicable law, Market Window is not responsible for losses arising solely from your reliance on information supplied by a business, user, third party or external source where Market Window did not create or independently guarantee that information.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.

Nothing in these Terms removes rights or remedies that cannot lawfully be excluded.

27. Your responsibility for unlawful or harmful use

If your use of Market Window violates these Terms or applicable law and causes legitimate loss, damage, claims or expenses to Market Window or another person, you may be responsible to the extent provided by law.

This provision does not make you responsible for matters that were not caused by your conduct or that cannot lawfully be assigned to you.

28. Privacy and personal information

Your use of Market Window may involve the processing of personal information.

Our Privacy Policy explains what information we collect, why we use it, how we protect it, and the choices and rights available to you.

By using Market Window, you acknowledge that you have had an opportunity to review the Privacy Policy.

29. Changes to these Terms

Market Window may update these Terms when our services, features, business practices or legal requirements change.

The updated version will be published on this page together with its effective or updated date.

Where a change is material, we will take reasonable steps to bring the change to users' attention. Continued use of Market Window after the effective date of updated Terms may constitute acceptance of the updated Terms to the extent permitted by applicable law.

30. Governing law

These Terms are intended to be governed by the laws of the Republic of Ghana, subject to any mandatory legal rights or requirements that apply to a particular user or transaction.

Any dispute arising from these Terms or your use of Market Window should first be brought to our attention so that we have a reasonable opportunity to understand and resolve the matter.

31. Disputes and complaints

If you have a complaint about Market Window, a listing, User Content, an account decision or another aspect of the platform, please contact us first.

We will review legitimate complaints and, where appropriate, request additional information before making a decision.

Nothing in these Terms prevents a person from exercising a legal or regulatory right that cannot lawfully be waived.
